Why does this D suspended 2 not sound major or minor?

Both pictures are D, E, and A. There is no F sharp and no F, so this is not D major and not D minor. E is the extra note (a 2nd). The first picture mutes the two thick strings and has no barre. The second picture bars fret 5. Same three notes. The barre shape has more bass.
